GORGOROTH v. GORGOROTH: THE RESULTS!

MS Maniac Kye has alerted us to the fact that Gorgoroth’s official website has posted an update regarding the long-brewing Gorgoroth naming rights battle, in which Gaahl and King ov Hell attempted to trademark the Gorgoroth name shortly before quitting the band. And…. the verdict has come down in favor of Infernus:
Oslo City District Court has today delivered a verdict on the main question in the Gorgoroth trademark case, which took place at the end of January 2009. The court has decided that King ov Hell’s trademark registration # 243365 of the band name Gorgoroth is NOT valid and shall therefore be deleted. The court states that King ov Hell and Gaahl excluded themselves from the band Gorgoroth when they tried to fire Infernus in October 2007. The court further states that Infernus cannot be excluded from Gorgoroth, unless he himself decides to quit. Infernus is very pleased, but not surprised, by this verdict. The remaining issues concerning financial matters and such are yet to be decided upon.
I’m not a big enough Gorgoroth fan to care much one way or the other, but presumably some of you will be extremely excited/outraged about this development. Battle it out in the comments section.

Well obviously since I’ve made the effort to keep up to date with this, I am a big enough Gorgoroth fan to care.
And I’m kind of at an odd place in my opinion. I actually think this was the best way to go I suppose. Technically I do feel Infernus owns the rights to the name as he did indeed start the band and though King has written the music for their recent output, that doesn’t make up for the years Infernus put into the band.
That being said, I think the best incarnation of Gorgoroth was the one that featured all three of these men. What I’m hopeful for is that the new Gorgoroth album will pick up where Incipit Satan’s experimental nature left off and the new album from King and Gaahl will continue in the same direction as the last two albums.

I like Gorgoroth, but really, who cares who has the rights to the name? Either side could start a band called “Hot Male Ejaculation” for all I care. If the music is good, I will proudly wear their t-shirt.
Really, the best part of all this is the best part of black metal in general: reading legal dockets, serious news articles, and mainstream magazine pieces featuring names like “King ov Hell” and “Infernus”. These guys should be bigger just so CNN will do stories about them. I’d like to watch Robin Meade stumble over pronouncing Gorgoroth.
Really is the name Gorgoroth that cool of a band name that you’d waste your time and money in litigation over? I wouldn’t. Just call your new band “the freebirds”. Hey, it couldn’t be any worse than Gorgoroth (what does that even mean?).

Well, I think this was the right call by the courts. I could care less about where the name Gorgoroth ends up, as long as Gaahl and King stay together and continue making music under some name.

I’m with Kevin on this one, as long as King and Gaahl continue to make great music I don’t really care what name they decide to do it under.

if they do go with “Hot Male Ejaculation” i’ll still listen to their music but there is no way i’m wearing their band shirts.

Guess that not too many people care, I think this is good for both parties, winner and losers, Gaahl and King will release an album with a new name so many people will want to check that out. Infernus will have a lot of pressure too with the name and all so all eyes will be on them oh and there will be a lot of comparisons between them.
What about…Gaahlgoroth for the losers of this trial……or Gaygoroth in case “he” goes solo!
I think this was a smart decision on the court’s part.
It doesn’t make sense for the guys who didn’t start teh band to fire the only original member left and still call it gorgoroth.

I’m okay with this decision, and am glad that the whole silly debate is finally over. Also, Gaahl & Kvitrafn’s new neofolk-ish project, Wardruna, fucking rules.

Anyways, the situation is over now. I think we will all be keeping an eye out for both parties and what becomes of them. That beig said, everyone keep rocking.
