REGARDING THE LEAK OF CONVERGE’S AXE TO FALL
Tuesday, October 6th, 2009 at 10:00am by MetalSucksAs you may have heard by now, yesterday Converge’s new album, Axe to Fall, leaked. The watermarked files demonstrate that the leak originated with a MetalSucks staff writer, Shaun Hand.
We would like to formally apologize on behalf of everyone at MetalSucks for the leak. We take full responsibility.
It might be small solace, but the album was absolutely NOT leaked intentionally. Prior to this incident, neither MetalSucks nor any member of the MetalSucks staff has EVER leaked, or even been accused of leaking, an album in the entirety our nearly three-year history as a website. We are honestly baffled as to how this one slipped out.
We are also deeply embarrassed and regretful. We would never knowingly betray the trust of any band or label. And if you’ve been following this site, you know that we’re huge fans of Converge and Axe to Fall. That this happened with a band and record we hold in such high regard makes the whole thing especially upsetting to us.
We obviously can’t “undo” the leak, but are currently working with the label to see if there’s anything we can do to try and make it up to the band. Once again, we’d like to offer our sincerest apologies to the band, the label, and all of the band’s fans, and stress that we are just as upset about this as they are.
And for what’s it’s worth, we’d like to re-emphasize that we think that Axe to Fall is a terrific album, and absolutely worth PAYING FOR when it is released on October 20. You can, and should, pre-order it here.

I’m not sure what the big deal about Converge is either – they play this on Liquid Metal quite a bit. The vocals really add nothing to the music, which isn’t that interesting anyway.

I downloaded the album to check it out 2 or 3 days ago, so if your watermarked copy “leaked yesterday”, I don’t think it was you who leaked it first. The version I have is 192kbps, what quality mp3 is the one linked back to you guys?

Why even listen to a watermarked copy? I hate that shit. Id rather pay for it.
I think the watermark they’re talking about is simply a way to trace back to the original source, not a voiceover promoting the album or anything like that. Not sure if the version I downloaded is from the guy at MetalSucks, but it doesn’t have any voiceovers.
There is a difference between watermarked and “Beeped copies”. Some labels release watermarked copies to websites for review. Many labels do this to insure that the person reviewing does not intentionally leak it and if they do, then they can trace it back to the source through the digital watermark, which is encoded onto the cd. Even if someone hacks in to your computer and steals the files and leaks them, you are still responsible. It could happen to anyone.
If a company goes to the trouble to add the “watermark” then they most certainly intend to prosecute any infringment that they catch.
By this time next week metalsucks.com will be owned by Epitaph Records (not that Metalsucks has any assets or value).

One piece of advice. Show up EARLY! I went to this show last weekend and the doors open at 6:30. High on Fire was done by 7:15 when I got there. I was so fucking pissed. They were half the reason I bought the ticket. I am pretty sure they are rotating first and second slot with Converge so don’t do what i did.
Great show, but I did not realize Mastodon was fucking opening for Dethklok. Bullshit. Also, most of the Dethklok fans were not into Mastodon. Pretty fucking retarded.

Your lack of humor surprises me. It’s a popularity contest and somehow Dethklok is more popular then Mastodon at the moment. Actually, I will probably garner more listens from the Dethalbum II than I will the last 2 Mastodon albums combined. My preference of metal is more traditional though.

I really really really tried this album a few times…BUT I gotta say, and in my own opinion – I just don’t see what is so good about it…I mean…There’s nothing that cool to me about this band’s music. Or maybe I’m wrong…I just don’t see what the appeal is here. Can anyone point me to a good song of theirs so I can get a feel for it?

Had you guys not spent as much time as you have promoting that record on your site, probably half the people who downloaded it wouldn’t have known its release was on the horizon otherwise. For that fact alone the band and the label should go easy when assigning your penance.
This is one of the most anticipated metal releases of the year. They’ve had extensive coverage in AP, Decibel and Revolver this month alone. MS has definitely plugged the shit out of it, but please don’t think this was a secret.

Agreed. This is a rotten thing for all parties involved and I don’t question the sincerity of the apology from the MS guys. Kudos to Axl & Vince for humbling yourselves as I know this whole thing is embarrassing and I think your credibility will remain intact as long as you are willing to make the proper reparations. I also hope the guys in Converge and their label feel the same way. As a fan, I intend to simply wait for my pre-order to show up in my mailbox.

Thanks MetalSucks, your leak made my day ;) Don’t worry, I still plan on supporting the band. Most bands don’t make much off cd sales unless they’re on a huge label anywho. Converge prob rely more on touring and merch sales. A lot of bands I’ve spoken to have told me they don’t care if their fans steal their cd from the record shop, as long as they have it and like it enough to come out and see them when they tour.
Now, if we can only get World Painted Blood in Shaun’s irresponsible little hands. Also, for anyone interested the new PELICAN cd leaked too. All in all, a pretty good day.

Dear morons: I wish some of you could wrap your heads around the notion that stealing music is not just about the potential loss of revenue for the band or the label.. If you make a sandwich and someone steals that sandwich it doesn’t necessarily mean you are now going to starve. But it does mean you had your fucking sandwich stolen. You no longer can eat that sandwich on your terms. And if you’re the asshole thinking about stealing my sandwich understand that just because you have access to it doesn’t mean you should take it. Converge has the right to be pissed about this because they’ve lost control as much – if not more than – they’ve lost money by having their album leaked. Bands fight their entire careers to have control over their art and their image. The ones who earn control do so typically because they write really good shit and because they won’t under any circumstances compromise. So think about that jackasses. When you steal music you’re stealing a band’s independence. Not only that you devalue all music and when music no longer has any real value (and don’t think that day isn’t fucking coming) then where the hell do you think the NEXT Converge is going to come from?
Music will still have value, it’s just the recordings of music that will cease to be profitable commodities unto themselves. If bands release their music for free, they are still going to drive fans into the concert halls and to the merch booth- which is where they make their money anyway. The only thing collapsing under the weight of the file-sharing revolution are the shit-head record companies which routinely ass-rape artists with shitty contracts.
This whole thing is a bit over-blown. Yes, it is a breach of trust- which deserves indignation- but to imply that somehow Converge is going to lose money is silly. The day the CD comes out, there would have been versions up on the networks anyway. The people who were going to steal it, were going to steal it anyway- they just did it sooner.
If you want to support the band- preorder the CDs directly from them, preferably in any ‘deluxe’ package w/ premiums (which are the part they make more money from). Then go to their shows and pick up a shirt or two.
In the 80s, I was turned on to countless bands via mix-tape trades with friends. It was the file sharing of it’s time. Overwhelmingly, I purchased the full records of bands I liked from those tapes, bought merch and tried to see them live when I could.
I downloaded the Axe to Fall leak- but I also paid to see them last Friday, bought a shirt and had already preordered the CD/Shirt/Lithograph package.

order it from them, or buy it from them in person- either way they are getting their share of the royalty AND the share for the retailer. They will make more money from CDs that they retail themselves.
the retailers share of the asking price can be as much as double the royalty or more. Buying direct from the artist gives them a hell of a lot more per unit than purchasing through a 3rd party.
The whole point of preordering a ‘deluxe’ bundle is that their profit margin on T-Shirts and Lithos are much higher. If you want your favorite bands to make money, buying their merch and music directly from them maximizes their share of your money- and minimizes how much, if any, goes to suit-and-tie shitheads who don’t actually write and play the music.
I agree, i mean sure -principles are one thing, but the reality is that the world is changing very rapidly.
Professional musicians need to adapt to the new commercial environment, don’t try to grasp on to the last vestiges of a corrupt age of record industry greed -it was never in their (the artist) best interests anyway (quite to the contrary).
Trust me, things are going to be WAY better for the truly independent recording artist. It is finally leveling out into a situation where commercially-mass-produced artists fall into the great black hole of cyberspace file-sharing, while bands of integrity (such as Converge) who earn a loyal connection with a listener benefit from the self promotion that GOOD music naturally creates.
I sometimes download music, and though cautious of the “rights” of an artist, have never cared a less about “ripping” anyone off, because if I like it I ALWAYS BUY it online/from a record store, and often as special edition or vinyl, and can’t wait to see them live when he/she/they tour of course!

They’re the artists. It’s THEIR product. Just because a consumer likes the band doesn’t mean Converge owes that consumer jack shit unless it’s on their terms. Even if that consumer steals the album, falls in love with it, and plans on buying it when it’s released they’re not honoring the band’s wishes and I see this as disrespectful and ultimately extremely damaging over a long term. And Christopher – this is what I’m talking about when I say music is in danger of losing its value. It’s NOT just monetary! If we all just think it’s perfectly acceptable to download a leaked album, or fuck – even buy a song for 99 cents (think about that!!), then at what point does it all just become disposable blips of entertainment? Think about a world thirty years from now where the next generation of metal bands have grown up never having to had once pay for an album. Never once having had to go outside to see a band play live (just watch it on YouTube!). Where bands exist only as MySpace pages and there’s not even the need for record labels. That’s not future shock, dude. It’s already happening and the vast majority of people seem to think it’s perfectly okay and are even deluding themselves into thinking this is somehow a good thing. But seriously – how could this possibly have a positive effect on the CREATIVE value of music?? Are we kidding ourselves into thinking good music is going to come from a generation of musicians who have never once had to consider which CD is worth spending their weekly allowance on? Fuck that. Rebuttal: No matter what, the number one factor in the enablement of creativity is accessibility. The more people hear it, the better for you, and the more creative you can be next time around. The guys in Converge were actually happy that the album leaked. Some of us aren’t content waiting for one album by one band. We listen to hundreds of new albums every single day, thus increasing our exposure to new artists, an what artists care about most is if people are hearing their music. Waiting is not fun at all, waiting doesn’t make the music better, all it does is make expectations way too high. Unless you’re buying a vinyl (which I really love, but is also impossible to afford if you want to hear hundreds of new albums in a day), the artwork is reduced to a tiny little pamphlet. Nobody watches bands on YouTube instead of seeing them live, however, having music be a click away whenever you want it enables people to listen to much more music by many more artists. Any smart artist would WANT people to hear their music for free and as soon as it’s ready to be heard, not after months and months of waiting even though the product is complete. I know personally, I’m just as pumped if not more pumped when I see that an album is available on the internet than I am when it comes out in stores. I’m just as excited to hear the music, and if the music is good, I’m just as eager to give the band my money by seeing them live and buying their merchandise. This is the information age, and it’s all about exposure. That being said, I’ll still buy an album on vinyl if I’ve already heard it and I’m sure it’s worth it.

i’m a huge converge fan, but honestly I would have never had the chance to get to know their music without bloggers leaking/uploading their albums to file sharing sites. I have since purchased every single album, purchased merchandise and gone to several shows.

The reality is that this album would leak eventually. It comes out in like two weeks so it’s not like that is nearly as damaging as say, Nile’s new album leaking almost a month and a half before it is to be released.
Converge’s last album sold around 20,000 copies in the US alone, and that album leaked as well at least a week in advance if memory serves me right. This new album will definitely sell as much if not more, given them being on some high profile tours and all the promotion Epitaph is putting into it.
Oh and btw, Axe To Fall is seriously mindblowing. Converge is one of the best live bands ever, of any genre, and all you haters might consider giving them a shot in a live setting. Not saying you’ll like their music any more, but you may give them more respect as artists and performers.
Question: Why is it legal for me to check a cd out from my local library and copy it to my computer, but it’s illegal to download a copy of the same album from a filesharing website?

I’ve wondered this forever, and maybe someone who’s a little bit smarter than me can set me straight. What the hell is so bad about a leak? Is it really that terrible for the band if people hear their album a little bit earlier than they thought? I mean shit, that’s a pleasant surprise for fans. And it’s not like the ridiculous amount of time taken between the album’s completion and release date just to build hype is actually going to build any hype. Plus, 9 times out of 10 building hype undermines peoples’ experience of your album when it does finally drop because they expected the album to give them full-body orgasms after waiting so long for it. Everyone knows your band was in the studio, everyone knows you’re releasing a new album, and everyone is going to download it for free off the internet regardless of whether or not it’s available in stores. Plus you barely make a penny from album sales anyway, and everyone who downloaded that album is going to see you play live and buy your t-shirts. So I think bands should release their albums fresh of the presses. In other words, the very second the album is mixed and mastered and the packaging and artwork is ready (which is always months before the release date), send that shit out to the stores. That would do wonders for business. Imagine if you walked into a record store and there was, for example, a brand new Tool album just sitting there that you didn’t really know anything about. Of course you’d fucking buy it, unless you don’t like Tool in which case you wouldn’t have bought it anyway. Fuck, leak your onto the internet on purpose. It’s almost 2010, for fuck’s sake, get with the times.

I completely disagree about the politics of albums leaking. It’s quite evident that you’re all the products of a brainwashed Napster generation. Whatever happened to the build-up of a release date? Think of music like sex, and the people who download a leaked album as premature ejaculators. And the person who leaks the album as someone who never gets laid.

I know that the folks who run this website are shiesty, nasty little fuckwads who play dirty. Just in case you ladies are plotting behind my back…if I find ANY sort of virus on my computer, I’ll know it’s because of this, and I will track it down (I DO have the means), show up at one your staff member’s houses (likely a trailer), break their ankles with a brick, blowtorch their face, and put the fire out with a fork. I am crazy as hell and willing to drive anywhere in the country, should this be the outcome.

The build-up of a release date is meaningless. It’s certainly nothing like sex, that’s the most retarded comparison I’ve ever heard. All it does is make you hope/think the album is going to be incredible, and 9 times out of 10 the album is just pretty good. So when you download a leaked album and it’s pretty good, you see it as such. But when you wait and finally buy a hyped up album that’s been complete for 4 months on its release date, you often see it as a piece of shit because it couldn’t live up to your overblown expectations,
no one makes money off of album sales anymore unless they’re metallica or kiss.
fuck converge if they are mad about this, they should be psyched that people want to download their shit and then see them live.

I don’t understand why bands don’t understand that fans spreading their music all over the internet to eager listeners everywhere is actually a GOOD thing. I’m glad the leaker put the album out there on the internet. Why? Because I wanted to hear it. There’s a million bands out there these days who would kill for such exposure.
